Terms and Conditions

Article 1 - Definitions
In these terms and conditions, the following definitions apply:
- Beepify: the limited liability company Beepify B.V., established in the Netherlands, Chamber of Commerce number: 94654069.
- User: the natural or legal person who creates an account and/or takes out a subscription.
- Service: the SaaS solution for creating and managing digital stamp cards.
- Subscription: the agreement whereby User gains access to the Service for payment.
- End customer: the customer of User who uses the digital stamp card.
Article 2 - Applicability
- These terms and conditions apply to all offers, agreements and services of Beepify.
- By creating an account or purchasing a subscription, User agrees to these terms.
- Deviations from these terms are only valid if agreed in writing.
- Beepify reserves the right to change these terms. Changes will be announced at least 30 days in advance.
Article 3 - Account and Registration
- To use the Service, User must create an account.
- User guarantees that the provided information is correct and complete.
- User is responsible for keeping login credentials secret and is liable for all use of the account.
- In case of suspected unauthorized use, User must inform Beepify immediately.
Article 4 - Trial Period
- New users receive a free trial period of 30 days.
- During the trial period, User has access to all features of the chosen plan.
- After the trial period, the subscription is automatically activated unless User cancels before the end.
- Beepify sends reminders before the end of the trial period.
- No credit card or payment details are required to start the trial period.
Article 5 - Subscriptions and Pricing
- Beepify offers different subscription types: Free (free), Starter (€64/mo), Professional (€124/mo) and Multi-Location (€299/mo).
- All prices include VAT.
- Payment is made monthly in advance via the payment methods offered by our payment processor.
- Price changes are announced at least 30 days in advance and take effect in the next billing period.
- Upgrading to a higher plan can be done immediately. Downgrading takes effect in the next billing period.
Article 6 - Cancellation
- User can cancel the subscription at any time via the dashboard or by email.
- The subscription remains active until the end of the current billing period.
- Amounts already paid are not refunded.
- After cancellation, User retains 30 days access to their data for export.
- After this period, all data is permanently deleted in accordance with our privacy policy.
Article 7 - Use of the Service
- User obtains a non-exclusive, non-transferable right to use the Service.
- User may not use the Service for illegal purposes or in violation of these terms.
- It is prohibited to reverse-engineer, copy or distribute the Service.
- User is responsible for the content of their stamp cards and communication with End customers.
- Beepify reserves the right to suspend accounts in case of abuse.
Article 8 - Availability and Maintenance
- Beepify aims for an availability of 99.9% (excl. scheduled maintenance).
- Scheduled maintenance is announced at least 48 hours in advance.
- Beepify is not liable for damages due to outages or interruptions.
- Support is available via email. Enterprise users receive priority.
Article 9 - Intellectual Property
- All intellectual property rights to the Service belong to Beepify.
- User retains the rights to content and branding they enter.
- User grants Beepify the right to process their content for the Service.
Article 10 - Privacy and Data Protection
- Beepify processes personal data in accordance with the Privacy Policy and the GDPR.
- User is responsible for the lawful processing of End customer data.
- A data processing agreement is part of these terms.
Article 11 - Liability
- Beepify's liability is limited to direct damages and to a maximum of the subscription costs of the last 12 months.
- Beepify is not liable for indirect damages, consequential damages, lost profits or missed savings.
- Beepify is not liable for damages due to force majeure, including third-party outages, internet failures or cyber attacks.
- User indemnifies Beepify against third-party claims related to the use of the Service.
Article 12 - Disputes and Applicable Law
- These terms are governed by Dutch law.
- Disputes are submitted to the competent court in Amsterdam.
- Parties will first try to resolve disputes in mutual consultation.
